    The Genetic Information Non-Discrimination Act (GINA) went into effect November 21, 2009. It adds another category to the Equal Employment Opportunity Commission’s (EEOC) list of prohibited forms of discrimination in the workplace. Title II of GINA prohibits health insurers and employers from collecting and/or using genetic information on applicants, employees, or employees’ family members.     Regal Entertainment Group, a national movie theater chain, will pay $175,000 and furnish significant remedial relief to settle a discrimination lawsuit brought by the U.S. Equal Employment Opportunity Commission (EEOC). The EEOC had charged that the company subjected a male employee to sexual harassment by a female co-worker and then retaliated against him for complaining about the unlawful conduct.     The U.S. House and Senate have passed and the President has signed legislation extending the COBRA subsidy portion of the American Recovery and Reinvestment Act (ARRA). This extends the eligibility period for the COBRA premium reduction for an additional two months through February 28, 2010.     The U.S. Department of Labor (DOL) has just released a Spanish version of the newly required USERRA poster. All employers must display the new USERRA poster as of March 10, 2005, and employers that have Spanish speaking employees should display the notice in Spanish. Both the English and Spanish versions of the USERRA poster may be printed, free of charge, in the Poster section. [4/11/05]
  • NO CHANGE IN THE FEDERAL MINIMUM WAGE
    Last week the U. S. Senate rejected two competing amendments to raise the minimum wage. The first amendment, offered by democratic Senator Edward Kennedy, would have increased the minimum wage over a period of two years from the current $5.15 an hour to $7.25 an hour. The second amendment, offered by republican Senator Rick Santorum, would have increased the minimum wage to $6.25 over two years. Neither amendment received support from the opposing party, and both failed. As a result, the federal minimum wage remains at $5.15.   [3/15/05]

  • OSHA POSTING REMINDER
    Employers with 11 or more employees must post the OSHA 300A, Summary of Work-Related Injuries and Illnesses, from February 1 through April 30. OSHA Form 300A is a summary of the injuries and illnesses that occurred during 2004, and is to be displayed in a common area wherever notices to employees are usually posted. The log must be posted even if there are no injuries or illnesses for the year recorded (Note: employers with 10 or less employees are generally exempt from this requirement as are certain exempt industries.)   • NEW MINIMUM WAGE AS OF JANUARY

    As of January 1, 2005, the Illinois Minimum Wage increases to $6.50. Employees under 18 may be paid 50 cents less per hour. The minimum wage increase is due to the 2003 amendments to the Illinois Minimum Wage and Overtime Act, which raised the minimum wage in two increments. The first increase occurred on January 1, 2004, when the rate went from $5.15 to $5.50. The second increase occurred on January 1, 2005, raising the Illinois Minimum Wage to $6.50.  [1/13/05]

  • LABOR DEPARTMENT MODIFIES CHILD LABOR RULES
    The Department of Labor (DOL) recently published final regulations implementing changes to the Fair Labor Standards Act's (FLSA) child labor laws. In general, the minimum age for employment in non-agricultural jobs is 16, but the DOL also permits 14- and 15-year-olds to work in a limited capacity in certain jobs in retail, food services, and gasoline service establishments while prohibiting their employment in other occupations. The new rules, which become effective on February 14, 2005, expand protections for youth working in restaurant cooking, roofing, and driving, among other changes.  Read More...  [01/05/05]
